General Terms and Conditions (GTC)

Scope
These GTC apply to all services provided by Wildkraut Berlin, in particular the rental of boats and onboard catering. The contractual partner is Wildkraut Berlin.
§1 Contract & Services
Bookings require a written request outlining all key details. Changes must be confirmed in writing. A non-binding offer will be issued; the contract is only concluded once the signed booking confirmation is returned within 7 days.
Participant numbers and services must be agreed in advance.
Prices are net (plus VAT).
Payment terms: Payment needs to be paid 100% upfront, 7 days before the event. Late payment may result in cancellation.
§2 Service Execution
Routes may change due to external conditions.
§3 Cancellation by Customer
Cancellation fees apply:
- up to 4 weeks: 10%
- up to 2 weeks: 25%
- less than 2 weeks: 50%
If Wildkraut Berlin is responsible for cancellation, payments will be refunded.
§4 Withdrawal by Wildkraut Berlin
Wildkraut Berlin may cancel the contract if payments are missed, false information is provided, safety or legal concerns arise, or force majeure prevents performance.
§5 Liability
Liability is limited to intent and gross negligence, except in cases of injury to life, body, or health.
Guests participate at their own risk. The customer is liable for damages caused by themselves or their guests and must ensure proper insurance if requested.
§6 Boat Rules
Instructions from crew must be followed at all times. The customer is responsible for all guests.
Key rules include:
- No own food/drinks (fees apply if violated)
- No dangerous or inappropriate behavior (e.g. harassment, climbing, throwing objects)
- Respect capacity limits and safety instructions
- No smoking except in designated areas; no open fire
- Cleanliness must be maintained (fees for violations)
- Children must be supervised
Violations may result in immediate termination without refund.
§7 Jurisdiction
Place of jurisdiction is Berlin. German law applies.
§8 Final Provisions
All changes or notices must be made in writing. If individual clauses are invalid, the rest remain unaffected. The latest version of the GTC applies.
